This Privacy Policy discloses how we collect, use and share information that we gather about you on the DEFENSOR mobile application and other related services agreed upon between you and MAXIMUS SOLUTIONS LLC (“MAXIMUS”). DEFENSOR is a trademark and business name that is owned by MAXIMUS SOLUTIONS, LLC (“MAXIMUS”). All rights are reserved.
A. Use of Personal Information
The Application obtains the information you provide when you download and register the Application. Registration with us is optional. However, please keep in mind that you may not be able to use some of the features offered by the Application unless you register with us.
When you register with us and use the Application, you generally provide you’re a) contact information, including full name, email, postal and residential address, b) brand and model of the smartphone in which the App will be installed, c) payment information, such as name of bank and account number, credit card number, d) personal health conditions, such as blood type, allergies, medicines used, age, dependents, workplace address, phone work, position, company, name and info of the person to call in case of emergency contact, e) information you provide us when you contact us for help, and; f) information you enter into our system when using the Application, such as contact information and project management information.
B. Use of real time Location Information
When you visit the mobile application, we may use GPS technology (or other similar technology) to determine your current location in order to provide the services agreed upon. We will not share your current location with other users or partners. However, for the services provided by the DEFENSOR App to work properly, you need to keep the GPS function on your cell phone activated, which allows geolocation of the Customer in the MAXIMUS Central Monitoring Center (CMC). You agree to share with MAXIMUS your location information with the GPS function and expressly waive any possible claims arising out of or related to your privacy rights over your location information and authorize MAXIMUS to access said information, as well as any other private information accessed by MAXIMUS for the purposes of providing its services.
C. Access to Information by Third Parties
We may disclose your information to third parties under the following circumstances:
- Information that has to be provided to the responding government agency or private entity that will provide the security, medical or roadside assistance in order to properly provide these services will be shared, which may include personal health conditions, such as blood type, allergies, medicines used, age, name and contact information of the person to call in case of emergency contact, as well as GPS location information. Only the information necessary to meet the emergency will be shared.
- As required by law, such as to comply with a subpoena, or similar legal process;
- When we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;
- With our trusted services providers who work on our behalf, do not have an independent use of the information we disclose to them, and have agreed to adhere to the rules set forth in this privacy statement.
D. Waiver
By accepting this Privacy Policy, you expressly waive any possible claims arising out of or related to your privacy rights over the personal information provided by you to enable the proper functioning of the DEFENSOR App and/or related services provided through your agreement with MAXIMUS, which includes any and all claims related to any privacy rights over your email, postal and residential address, payment information, such as name of bank and account number, credit card number, personal health conditions, such as blood type, allergies, medicines used, age, dependents, workplace address, personal phone number, GPS location, and any other information you provide to MAXIMUS in relation to the services agreed upon. We will only use your information as is necessary to provide the services agreed upon between you and MAXIMUS.
E. Security
We are concerned about safeguarding the confidentiality of your information. We provide physical, electronic, and procedural safeguards to protect information we process and maintain. Access to this information to authorized employees and contractors who need to know that information in order to operate, develop or improve our Application. Please be aware that, although we endeavor provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches.
F. Revising or changing your personal information
If you wish to revise or change your personal information, please send an email to registro@defensorpr.com, explaining the reason to request review or additional personal information. After review, you will receive an email granting you access to an encrypted link to provide the requested information. If you do not respond to the first email, a second email will be sent and text message or push notification will be sent to you.
G. Changes
This Privacy Policy may be updated from time to time for any reason. We will notify you of any changes to our Privacy Policy by posting the new Privacy Policy in our website and informing you via email and/or text message. You are advised to consult this Privacy Policy regularly for any changes, as continued use is deemed approval of all changes.
